Dubai: Teen Who Killed 33-Year-Old Appeals His Life Sentence

According to court records, the 19-year-old stabbed the victim outside of a shisha café in Business Bay. A teenager from Israel who was found guilty of murder in Dubai is attempting to have his life sentence commuted. Documenting an allure in court, his legal counselor said the young fellow “acted with good reason”. 

The 19-year-old visitor was found guilty in January by the Dubai Court of First Instance of “premeditatedly killing” a 33-year-old man in the Business Bay area in May 2023. According to the records, the teen killed his fellow citizen by stabbing him with a knife. 

However, the defense attorney argued that there was no “deliberate intent” behind the killing. “My client was unfoundedly blamed for preplanning and premeditatedly killing the person in question… H.Y. (the litigant) had no conscious purpose to kill the person in question,” legal advisor Massouma Al Sayegh of Dar Al Balagh Promoters said under the steady gaze of the Dubai Allure Court. She stated, “The accused defended himself, and the [victim] initiated the assault when he attacked my client with a chair.” 

Other than the youngster, five of his companions were condemned to 10 years in prison each for helping and abetting. After serving their sentences, the six Israeli prisoners will be sent home. What started the incident? 

According to the documents that the defense lawyer provided to the appellate court, the group was inside the shisha café when the victim and his friend arrived. According to the lawyer, the victim was on his phone outside the door when his friend entered, saw the defendant, who was 19 years old, and cursed his mother and sister. 

The two of them argued. Then the companion left, needing to leave, while H.Y. also, his mates followed him. The victim tried to stop my client from chasing the friend by attacking him with a chair, but H.Y. defended himself and stabbed the victim to push him away,” the lawyer said, repeating that the accused “didn’t have any intention or premeditated intention to kill.” The suspects were located and apprehended by the Dubai Police less than 24 hours after the murder. 

According to the primary judgment and the findings of the prosecutors, it turned out that the group knew the victim and his family, and the murder occurred as a result of disagreements and resentment issues that had existed while they were in Israel. 

Al Sayegh argued that the victim had been threatening to kill her client back home, forcing H.Y. to come to Dubai to look for work, which is thought to be a new twist in the case. He came here to flee the victim’s death threats because he thought his life was in danger. He didn’t know that the casualty had been pursuing him, or that he was available in Dubai,” she told the court. 

“I didn’t intend to premeditatedly kill him, but I was defending myself and pushing him away when he attacked me using the chair… I wanted to fend him off,” the lawyer cited her client’s testimony during interrogation to support her defense. Based on article 98 of the Penal Code, Al Sayegh asked the appellate court to give her client a “reduced and lenient” punishment because he is under 21 years old. 

“The condemned was brought into the world on Walk 28, 2004 and according to the relevant regulations, the essential court ought to have thought about his young age and given him diminished discipline!” She stated In addition, the attorney argued that the client’s culture considered it “casual” to acquire a weapon and that the young man did not intend to kill the victim with the knife. Al Sayegh concluded her defense by asking the appellate court to dismiss the prosecutors’ appeal for a harsher sentence and acquit her client of murder. Judgment from the Appeal Court is anticipated in July.
